At the arraignment, you will be briefed on the charges, and plead guilty or not guilty. If you plead not guilty, the judge will then ask the prosecuting attorney for his or her recommendation on bail. Then the just will determine your actual bail.

Let’s say the judge assigns a bail of $5,000. To be bailed out, the court expects the bail in cash, but most people do not have that amount in their checking account. If no family member can come up with the money, a bail bondsman will be approached.

A bail bondsman will then required under Nevada law for you to come up with 15 percent in cash. The bail bondsman then adds the other 85 percent and bails you out.

The major difference between posting the bond in cash and having the bail bondsman do it? Win or lose, you will get your money back once you show up in court for your actual trial, but with bail bondsmen, they keep the 15 percent as their service fee.
